Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and daWorld Technologies (“daWorld.net”, “we”, “us”, or “our”) governing your access to and use of our platform, applications, and services (collectively, the “Service”).

1.Acceptance of Terms

By accessing or using the Service, creating an account, or clicking “I Agree” (or similar affirmative action), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and “you” refers to both you individually and the organization.

If you do not agree to these Terms, you must not access or use the Service.

2.Eligibility

  • You must be at least 16 years of age (or the applicable age of digital consent in your jurisdiction) to use the Service.
  • You must have the legal capacity to enter into a binding agreement.
  • You must not be prohibited from using the Service under any applicable law or regulation.
  • If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3.Account Registration & Security

3.1 Account Creation

  • You may register using an email address, phone number, or through a supported OAuth provider (Google, GitHub).
  • You agree to provide accurate, current, and complete registration information.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • Each individual may maintain only one personal account. Duplicate or fake accounts may be terminated.

3.2 Account Security

  • You must immediately notify us of any unauthorized access to or use of your account.
  • We are not liable for any loss or damage arising from your failure to maintain the security of your account.
  • We reserve the right to suspend accounts that exhibit suspicious activity, including but not limited to brute-force login attempts, credential stuffing, or unauthorized API access.

3.3 Guest Access (Lazy Auth)

Certain features of the Service are available without registration (“Guest Access”). Guest users may browse public content and the Polymorphic Feed. Creating content, joining organizations, and accessing premium features requires a registered account.

4.Organizations & Teams

4.1 Organization Creation

  • Any registered user may create an Organization on the platform.
  • The creating user becomes the Organization's Owner with full administrative privileges.
  • Organizations are subject to identity verification (Real-ID) for accessing premium features, financial tools, and social media integrations.

4.2 Roles & Permissions

  • Organization roles include: Owner, Admin, Member, and Viewer.
  • The Owner is responsible for the actions of all team members within the Organization.
  • Administrative actions (billing, integrations, member management) are restricted to Owner and Admin roles.

4.3 Multi-Tenant Isolation

Each Organization's data is isolated at the database level using Row-Level Security (RLS) policies. No Organization can access another Organization's content, credentials, or configuration.

5.Platform Services

daWorld.net provides the following core services, subject to these Terms:

5.1 Design Editor

A browser-based visual design tool for creating graphics, documents, presentations, and other visual content. Features include multi-page workbooks, layered canvas editing, template libraries, and collaborative editing.

5.2 App Builder

A visual application construction environment for building web applications, dashboards, and data-driven tools using drag-and-drop widgets, data binding, and workflow automation.

5.3 Workflow Automation (Logic Board)

A visual logic engine for creating automated workflows, including social media comment triggers, DM funnels, conditional branching, and API integrations. Automations execute within the constraints of connected platform APIs and rate limits.

5.4 OS Drive & Collaboration

A file management system for organizing, sharing, and collaborating on designs, applications, and documents within an Organization context.

5.5 Service Availability

We strive for high availability but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance when possible. We are not liable for downtime caused by third-party infrastructure providers, force majeure, or factors beyond our reasonable control.

6.Content Ownership & Licensing

6.1 Your Content

  • You retain full ownership of all content you create, upload, or import to the Service (“Your Content”).
  • We do not claim any intellectual property rights over Your Content.
  • You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute Your Content solely for the purpose of providing the Service to you.
  • This license terminates when you delete Your Content or your account.

6.2 Templates & Marketplace Content

  • Templates made available through the Service may be subject to separate licensing terms specified by their creators.
  • If you publish templates to the marketplace, you grant purchasers a non-exclusive license to use, modify, and deploy those templates for their own purposes.
  • You represent that you have the right to license all content you publish to the marketplace.

6.3 Feedback

Any feedback, suggestions, or ideas you provide regarding the Service may be used by us without restriction or compensation. You waive any rights you may have in such feedback.

7.Social Media Integrations

7.1 Authorization & Responsibility

  • By connecting a social media account, you authorize us to access and interact with that account on your behalf within the scope of permissions you grant.
  • You are solely responsible for the content of automated messages, comments, and interactions sent through the Service.
  • You must comply with all applicable platform-specific terms of service (Meta, LinkedIn, etc.) when using automation features.

7.2 Automation Limits

  • Automated messaging is only triggered in response to user-initiated interactions (e.g., comments on designated posts). Unsolicited mass messaging is strictly prohibited.
  • We enforce platform-specific rate limits and messaging windows (e.g., Meta's 24-hour window policy).
  • We reserve the right to disable automations that violate platform policies or these Terms.

7.3 Disclaimers

  • We are not responsible for changes to third-party platform APIs, terms, or rate limits that may affect automation functionality.
  • Account suspensions or restrictions imposed by social media platforms are the user's responsibility.
  • We do not guarantee delivery of automated messages; delivery depends on the target platform's infrastructure.

8.Payment, Billing & UGB Credits

8.1 Pricing & Subscriptions

  • Certain features of the Service require payment. Prices are displayed in your local currency where available.
  • Subscriptions renew automatically unless cancelled before the renewal date.
  • We reserve the right to change pricing with at least 30 days' notice before the change takes effect for existing subscribers.

8.2 UGB (Unified GB) Utility Credits

  • UGB credits are a prepaid utility used to consume platform resources (AI generation, exports, premium storage, automation triggers).
  • UGB credits are non-refundable, non-transferable, and carry no cash value.
  • Unused UGB credits do not expire as long as your account remains active.
  • All UGB transactions are recorded in a double-entry ledger system and are auditable by the Organization Owner.

8.3 Refunds

  • Subscription refunds are handled on a case-by-case basis within 14 days of purchase.
  • UGB credits are non-refundable once consumed. Unused UGB balance may be refunded within 7 days of purchase, subject to review.

8.4 Payment Processing

Payments are processed by Stripe (international) and Razorpay (India). We do not store credit card numbers on our servers. All payment data is handled in compliance with PCI DSS standards. See our Privacy Policy — Section 4 for details.

9.Acceptable Use Policy

You agree not to use the Service to:

  • Violate laws: Engage in any activity that violates applicable local, state, national, or international law.
  • Spam or harassment: Send unsolicited messages, spam, or harass other users or third parties through automation tools.
  • Malware: Upload, distribute, or transmit viruses, malware, or any destructive code.
  • Impersonation: Impersonate any person, organization, or entity, or falsely represent your affiliation.
  • Data scraping: Use automated bots, crawlers, or scrapers to extract data from the Service without authorization.
  • Unauthorized access: Attempt to gain unauthorized access to other users' accounts, our servers, or connected systems.
  • Reverse engineering: Decompile, reverse-engineer, or attempt to derive the source code of the Service.
  • Circumvention: Circumvent, disable, or interfere with security features, rate limits, or usage restrictions.
  • Illegal content: Create, store, or transmit content that is illegal, defamatory, obscene, or promotes violence or discrimination.
  • Platform abuse: Use social media integrations in a manner that violates the connected platform's terms of service.

Enforcement: Violations may result in immediate account suspension or termination without prior notice. We reserve the right to report illegal activities to appropriate law enforcement authorities.

10.Intellectual Property

  • The Service, including its design, code, trademarks, logos, and documentation, is owned by daWorld Technologies and protected by intellectual property laws.
  • The “daWorld” name, logo, and brand assets are trademarks of daWorld Technologies. You may not use them without prior written consent.
  • These Terms do not grant you any right, title, or interest in the Service beyond the limited license to use it as described herein.
  • Open-source components used within the Service are subject to their respective open-source licenses.

11.Third-Party Services

The Service integrates with third-party platforms and services. Your use of these integrations is also subject to the terms and privacy policies of those third parties:

We are not responsible for the practices, terms, or availability of third-party services.

12.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
  • DAWORLD TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL.
  • OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ₹5,000 (INR FIVE THOUSAND).
  • WE ARE NOT LIABLE FOR FAILURES, DELAYS, OR DISRUPTIONS CAUSED BY THIRD-PARTY SERVICES, API CHANGES, OR FORCE MAJEURE EVENTS.

13.Indemnification

You agree to indemnify, defend, and hold harmless daWorld Technologies, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service or any activity under your account.
  • Your Content or content generated through your automation workflows.
  • Your violation of these Terms or any applicable law or regulation.
  • Your infringement of any third-party intellectual property or privacy rights.
  • Automated messages, comments, or interactions sent through your connected social media accounts.

14.Termination

14.1 By You

  • You may terminate your account at any time by contacting support@daworld.net.
  • Upon termination, your personal data will be purged within 30 days (subject to legal retention requirements).
  • Content within an Organization you own will persist until the Organization is separately deleted by the Owner.

14.2 By Us

  • We may suspend or terminate your access for violation of these Terms, the Acceptable Use Policy, or applicable law.
  • For non-severe violations, we will provide 14 days' notice and an opportunity to remedy the violation before termination.
  • For severe violations (fraud, illegal activity, security threats), we may terminate immediately without notice.

14.3 Survival

Sections relating to Content Ownership, Limitation of Liability, Indemnification, Dispute Resolution, and Governing Law shall survive termination of these Terms.

15.Dispute Resolution & Governing Law

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

15.2 Informal Resolution

Before filing any formal dispute, you agree to attempt to resolve any dispute informally by contacting us at legal@daworld.net. We will attempt to resolve the dispute within 30 days.

15.3 Arbitration

  • Any dispute not resolved informally shall be settled by binding arbitration administered under the rules of the Indian Arbitration and Conciliation Act, 1996.
  • The seat of arbitration shall be New Delhi, India.
  • The language of arbitration shall be English.
  • You agree to bring claims only in your individual capacity, and not as a plaintiff or class member in any purported class action.

15.4 Jurisdiction

For matters not subject to arbitration, the courts of New Delhi, India shall have exclusive jurisdiction.

16.Changes to These Terms

  • We may modify these Terms at any time. Material changes will be notified via email or in-app notification at least 30 days before taking effect.
  • Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
  • If you disagree with the changes, you must stop using the Service and may request account deletion.
  • The “Last Updated” date at the top of this page reflects the most recent revision.
